At Alimentiv Inc. and its affiliated companies (“Alimentiv”, “We,” “Us,” or “Our”), we prioritize the protection of your (“Your”, or “You”) Personal Information (including health and other sensitive information) in accordance with applicable privacy and data protection laws and regulations, including EU General Data Protection Regulation ((EU) 2016/679 (GDPR) and the Canadian Data Protection Regulation (“Personal Information Protection and Electronic Documents Act – PIPEDA” or “Quebec Privacy Law – Law 25”). We also comply with the International Conference of Harmonisation (ICH) Guidelines for Good Clinical Practice (GCP) and, where applicable to Our clinical research activities, the regulatory requirements of the U.S. Food and Drug Administration (FDA), the European Medicines Agency (EMA), and Health Canada with respect to the collection, use, protection, and security of health and clinical trial data.
This Privacy Notice explains what Personal Information We collect and how We process, handle, share and store that information.
Personal Information means any information about identified or identifiable person. This definition also covers “personal data” definition as defined in relevant privacy laws including GDPR.
What types of Personal Information do We collect and why?
We may collect Personal Information about you when you interact with us through Our functions or business activities or other channels, such as requesting information (“Contact Us”), submitting an Request for Proposal (RFP), applying for a job, providing feedback, receiving a service, or participating in a clinical trial or research program.
We only collect Personal Information reasonably necessary for one or more of Our functions or business activities.

A) Human Research Studies / Clinical Trials
Investigator, Clinical Site Staffs and other Healthcare Professionals (HCPs)
We collect names, contact information, and professional information (such as resumes) of clinical trial investigators, researchers, consultants, and other HCPs for the purpose of identifying and evaluating Your suitability to assist in clinical trials and human research studies and to provide related services, and for the evaluation and conduct of clinical trials or human research studies in which you are involved with Us.
Clinical Trial Participants in Clinical Trials Sponsored by Clients
We provide services to sponsor’s clinical trials and human research studies. We process the Personal Information of subjects participating in these clinical trials on behalf of the sponsors in accordance with their written instructions and Our legal agreements with them. The purposes for which clinical trial participant Personal Information will be used by sponsors and Us will depend on the nature of the clinical trial and will be more specifically addressed in the specific clinical trial documentation.
Generally, Personal Information is collected and processed to assess eligibility for trial participation, manage and monitor the trial, conduct related medical research and analysis, comply with applicable laws and regulatory requirements, and support the validation and publication of research findings.”
B) Potential or Employment with Alimentiv
We may collect Personal Information from you when you become one of our employees or when you inquire about or apply for career opportunities with us.
Such Personal Information may include Your name, address, contact information, education history, past work experience, references, copies of identification documents, and professional qualifications. We will generally collect Personal Information directly from You, however We may use other sources such as recruitment agencies, publicly available websites, business partners, or institutions that You are affiliated with. We may also collect Your Personal Information from third-parties (e.g. referees) as part of Our assessment and recruitment process.
We may retain and use Your Personal Information for administrative, personnel and management purposes, to comply with Our legal and regulatory obligations, to maintain records related to employment and recruitment, and to conduct background and criminal checks as permitted by applicable law.
C) Our Websites
When a user visits our website, we do not automatically collect any personal information. We do keep track of certain information about users when they view our website content. This information includes, but is not limited to, the content viewed, the links that are clicked on, the time spent viewing content, how content is shared, location and device information.
We use cookies on our website to improve your user experience and to analyze how our website is used. A cookie is a small text file that is placed on your device when you visit our website. You can manage cookies through your web browser settings.
D) General Activities
In the ordinary course of Our business, We may collect and record Personal Information from Our relationships with partners, business alliances and service providers. Such information is collected for administrative, management and audit purposes.
We may collect Personal Information (e.g., name and contact information) from those who contact Us (by telephone, email or in person) or access Our Websites. Such information is collected in order to communicate with you and to improve Our services.
E) Children’s Privacy
Our websites and general business services are not directed at children under the age of 16. We do not knowingly collect Personal Information from individuals under the age of 16 without first obtaining verifiable consent from a parent or legal guardian.
The applicable age threshold varies by jurisdiction as follows:
- European Union (GDPR, Article 8): The age of digital consent ranges from 13 to 16 years depending on the Member State. Where a child below the applicable age threshold seeks to use our services, We require verifiable parental or guardian consent prior to any collection of Personal Information.
- Canada (PIPEDA / Quebec Law 25): We apply age-appropriate consent standards for individuals We know to be minors. For younger children, parental or guardian consent is required. All consent requests directed at or relating to minors are written in clear and plain language accessible to both the minor and their parent or guardian.
- United States (HIPAA / COPPA): For general website interactions, We comply with the Children’s Online Privacy Protection Act (COPPA) and do not knowingly collect Personal Information from children under the age of 13 without verifiable parental consent. Where Alimentiv processes protected health information in the context of clinical research involving minor participants, parents or legal guardians retain rights over that information until the individual reaches the age of majority under applicable state law. These rights are addressed separately in the applicable clinical trial informed consent documentation.
If We discover that We have inadvertently collected Personal Information from a child below the applicable age threshold without appropriate consent, We will take prompt steps to delete that information. If You believe We may have collected information from a child without appropriate consent, please contact Us at privacy@alimentiv.com.
Legal Basis of Processing Personal Information
We will process Your Personal Information when the law allows Us to.
Most commonly, We will process Your Personal Information based on one of the following legal grounds:
- Your consent
- The performance of a contract with you or in order to take steps at your request prior to entering into a contract
- Our legitimate interests (not overridden by your rights)
- Compliance with a legal obligation
Where Alimentiv processes Personal Information in connection with clinical trials or human research studies, additional regulatory frameworks may apply depending on the jurisdiction in which the trial is conducted. These include:
- FDA (United States): 21 CFR Parts 50, 56, and 312, which govern informed consent, the protection of human research subjects, and the handling of investigational new drug application data.
- EMA (European Union): EU Clinical Trials Regulation (EU) No 536/2014 and applicable EMA transparency policies, which govern clinical trial data management and the protection of trial participants’ Personal Information.
- Health Canada: Division 5 of the Food and Drug Regulations and applicable Health Canada guidance, which govern the conduct of clinical trials and the protection of personal health information collected in Canada.
In all cases, Alimentiv processes clinical research data in accordance with GCP standards. Privacy obligations specific to clinical trial participants are addressed in the informed consent documentation provided at enrolment, which is separate from this Privacy Notice.

Sharing of Personal Information
We may share Your Personal Information with agents, vendors, contractors or partners of Alimentiv in connection with services that these entities perform for, or with, Alimentiv. These companies are prohibited by Our contracts with them, which provide an equivalent level of protection, from using the Personal Information in any way other than to provide services to or for Alimentiv, or services for the alliance in which they and Alimentiv are involved. For example, companies We have hired to provide support or assist in protecting and securing Our systems and services may need access to Personal Information to provide those functions.
Disclosure of Personal Information
We may disclose Your Personal Information across international borders. As a global company, we have employees, agents, service providers, contractors and research partners in many countries, including the United States, the United Kingdom, the European Union and Australia.
Alimentiv will comply with legal obligations regarding the cross-border transfer of Your Personal information.
Most commonly, we will disclose Your Personal Information based on one of the following reasons:
- to satisfy laws, regulations, or governmental or legal requests for such information
- to disclose information that is necessary to identify our users (or, a user), such as:

- operating and maintaining the security of our proprietary materials, including to prevent or stop an attack on our computer systems or networks; or

In addition, Your Personal Information may be disclosed to third parties as part of research trials and studies. However, in general, trial participants’ personal information will be de-identified (or aggregated with others) prior to disclosure. Where personal information is shared with third parties, it will be subject to contracts we have in place with those organisations that provide an equivalent level of protection.
Storing of Personal Information
We will only retain Your Personal Information for as long as is reasonably necessary to fulfil the purposes for which We collected it, including to comply with any legal, regulatory, tax, accounting or reporting requirements. Additional Rights — Canada (PIPEDA and Quebec Law 25)
If You are located in Canada, You have the following rights under PIPEDA, and where applicable, Quebec’s Act respecting the protection of personal information in the private sector (Law 25):
- Right to Access: You may request access to the Personal Information We hold about You, subject to limited exceptions permitted by law.
- Right to Correction: You may challenge the accuracy and completeness of Your Personal Information and request that it be amended as appropriate.
- Right to Withdraw Consent: You may withdraw consent to Our use of Your Personal Information at any time, subject to legal and contractual restrictions.
- Right to Data Portability (Quebec): Residents of Quebec have the right to receive Personal Information held about them in a structured, commonly used technological format.
- Right to De-indexation (Quebec): Residents of Quebec may request that We cease disseminating their Personal Information or de-index any hyperlink attached to their name where such dissemination causes them harm.
- Right to File a Complaint: If You believe Your Personal Information has been handled in violation of PIPEDA or Quebec Law 25, You may file a complaint with the Office of the Privacy Commissioner of Canada (OPC) at priv.gc.ca, or with the Commission d’accès à l’information du Québec (CAI) at cai.gouv.qc.ca.
Additional Rights — United States
Certain U.S. residents may have rights under applicable state privacy laws, including the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA):

- Right to Delete: You may request deletion of Your Personal Information, subject to certain exceptions permitted by law.
- Right to Correct: You may request correction of inaccurate Personal Information We hold about You.

- Right to Non-Discrimination: We will not discriminate against You for exercising any of Your privacy rights.
For individuals participating in HIPAA-covered clinical research activities in the United States, additional rights under the HIPAA Privacy Rule apply, including the right to access and request amendment of protected health information. These rights are addressed in the applicable research informed consent documentation.
How to Exercise Your Rights
To exercise any of the rights described above, please contact Us using the details in the “Contact Us” section of this Privacy Notice. We will respond within the timeframe required by applicable law (generally 30 days, or as otherwise prescribed). We may need to verify Your identity before processing Your request. We will not charge a fee for reasonable requests but reserve the right to charge a reasonable fee or decline requests that are manifestly unfounded or excessive.
Protection of Personal Information
We take reasonable measures to protect Your Personal Information from unauthorized access, disclosure, or alteration. We use a variety of security technologies and procedures to help protect Your Personal Information from unauthorized access, use, or disclosure.
